Terms of sale
Terms of Sale for Digital Products
1. Seller and scope
The seller is Valentyna Sviatenko, Dreyerstr. 7, 30169 Hannover, Germany, trading as SVYATENKO. Contact: hello@svyatenkopatterns.com. These Terms apply to digital sewing patterns and related files; no physical product is shipped.
2. Contract formation, prices and payment
Product listings are an invitation to place an order. Before ordering, customers can review and correct the cart, price, currency, taxes and total. For Stripe, the customer selects Order and pay and completes the final payment action on Stripe’s hosted checkout. For PayPal, the customer approves the payment in PayPal’s Pay Now flow. By completing the applicable payment action, the customer submits a binding offer to purchase.
An automatic pending-order receipt only acknowledges that the order was received. The contract is concluded when SVYATENKO accepts the order after reliable server-side payment confirmation by sending the paid-invoice confirmation or enabling access to the purchased files, whichever occurs first.
Prices are shown in EUR. VAT is not charged or shown under the German small-business scheme pursuant to Section 19 UStG. Payment methods are listed in the Payment Policy.
3. Digital delivery and withdrawal
Supply begins after reliable server-side payment confirmation, and files become available in My Patterns. See Digital Delivery and the Withdrawal Information.
4. Licence
The customer receives a non-exclusive, non-transferable licence for personal use. The customer may print the pattern, sew physical items from it, and sell physical items sewn from it. Copyright in the pattern does not transfer.
The customer must not resell, share, publish, upload or distribute the digital files or copies of them.
5. Product conformity and customer responsibilities
Customers should check the disclosed sizes, formats, language and printing requirements. Mandatory statutory rights for digital products remain unaffected. Results also depend on accurate measurements, size selection, fabric, print scale and compliance with instructions.
6. Contract language and storage
The contract language is English. SVYATENKO stores the order details and the recorded digital-content consent. Customers can review their order summary in their account. An order receipt and a paid-invoice confirmation are sent by email, and the emails reproduce the Terms of Sale and Withdrawal Information applicable to the order so that the customer can retain them.
7. Governing law and disputes
German law applies, without depriving consumers of mandatory protections that apply in their country of habitual residence. No exclusive court jurisdiction is imposed on consumers.
